Strive To Maintain Public Trust, CJN Tasks Judges

The Chief Justice of Nigeria (CJN) Justice Olukayode Ariwoola, has tasked judicial officers in Nigeria to work assiduously towards sustaining public confidence and trust reposed on the judiciary.

Ariwoola posited that as indispensable pillars of democracy, judicial officers must distance themselves from all forms of indiscretions and ventures capable of bringing the judiciary to disrepute.

The CJN gave the charge at the opening ceremony of the 2023, All Nigerian Judges’ Conference in Abuja.

“My Lords, the importance of the foregoing cannot be overemphasized since what we do now will invariably determine the legacy we leave behind.

Justice Ariwoola described the conference as a “convergence of the most brilliant minds and mainstays of hope and order in the society” adding that the conference primarily serves the dual purpose of stocktaking and visioneering.

The CJN expressed dismay over the way decisions of the Court are treated with orders of the Court being flagrantly disobeyed.

“While there is no justification for this, it is impossible to divorce this unsettling development from the perceived image of the Judiciary as a mere appendage of the other arms of government, expected to do their bidding at all times and incapable of making decisions devoid of predilection.

He exuded confidence that the Conference, which is the first since the commencement of the new administration, will come with an improved disposition towards the welfare of the Judiciary especially as it pertains to the protracted issue of its independence as well as a strong desire to foster healthy and productive relationships among all three arms.

“It is my hope that the Conference will help drive robust discussions between the Executive, Legislature and the Judiciary on fostering mutual respect for one another and also on strengthening synergies devoid of any subterfuge.

“It will equally afford us the opportunity to unravel the issues already identified, the bulk of which holds grave repercussions for Nigeria’s polity.

“It is also my firm belief that this interface will reaffirm across the board, our commitment to upholding the tenets of Democracy and the Rule of Law therefore bolstering the trust and confidence of the citizenry in the operationality of the government” Justice Ariwoola stated.

In his welcome address, the Administrator, National Judicial Institute, Hon. Justice Salisu Abdullahi, said the Conference provides a platform to give judges the

acclaim for their unrelenting devotion to prospering the ends of justice, and for their conspicuous role in nation building.

Secondly, he said the Conference affords Judges the opportunity to critically appraise happenings and developments in the course of the year, especially those that greatly impacted the performance of their functions and which holds great implications for the Judiciary by extension.

“In the same vein, while it is a cardinal rule of natural justice that no one should be a judge in his own cause, this Conference offers an apposite exception to this since it allows judicial officers to evaluate and critique themselves, Abdullahi said.

The goal of such evaluation, he said, is to enable advancement and growth within the Judiciary through the conclusions that will be reached and strategies that will be devised from robust discussions led at the Conference.

He stated that the theme of the Conference; “STRENGTHENING JUDICIAL COMMITMENTS TO THE RULE OF LAW AND DEMOCRACY”, will afford Judges the opportunity to recharge, recalibrate and re-strategize.

Imo Guber: Court Denies Apapa’s Faction Motion To Stop LP Candidate

Justice Inyang Ekwo of the Federal High Court, has refused Lamidi Apapa’s faction prayer to stop the candidate of Labour Party, Chief Athan Achonu from participating in Saturday’s Governorship election in Imo State.

Ruling in an ex-parte application argued by counsel to the faction, Mohammed Ndarani Mohammed SAN, the court rather ordered Apapa and his group members to put the Independent National Electoral Commission (INEC) on notice on the existence of the suit to enable it put up its defense.

The faction had in the ex-parte application marked FCH/ABJ/CS/1357/2023, asked for an interim injunction restraining INEC from recognizing or according recognition to any other person laying claim to the gubernatorial ticket of the party in Imo State slated for November 11 other than Chief Ukaegbu Ikechukwu Joseph who emerged from Apapa led.primary election of April 16, 2023.

They also prayed for an order of mandatory injunction, compelling INEC to recognize and upload the name of Ukaegbu Joseph as the authentic gubernatorial and flag bearer of the party in Imo State.

The faction further demanded for a mandatory order against INEC that the name of Lamidi Apapa be uploaded as the national chairman of the party as well as Alhaji Lawal Saleh as national secretary.

In the ruling, Justice Ekwo turned down the request and ordered the faction to turn the ex-parte motion to motion on notice and serve same on INEC being the sole defendant in the suit.

“I am not granting you this application today and you have to bring INEC to Court to come and explain its own side in this matter,” the Judge said.

Meanwhile, the Judge has fixed further mention in the matter till November 10 to enable Apapa’s faction present its grievances and INEC to respond with its defense.

  • 151 Days After Unlawful Detention, Court Grants Emefiele Bail

151 Days After Unlawful Detention, Court Grants Emefiele Bail

The High Court of the Federal Capital Territory, Maitama, on Wednesday admitted the former Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele to conditional bail after 151 days in detention.

Justice Olukayode Adegbola Adeniyi held that Emefiele had stayed in government security custody beyond the time stipulated by law.

The Judge also predicated his decision on the fact that the Federal Government had completed investigation into the allegations against the former CBN Chief and had even prepared the charged against him as far as August this year.

On the bail conditions, the court held that Emefiele must be released to his Senior lawyer Matthew Burkaa SAN who must produce him any day the Federal Government chooses to arraign him.

Emefilele is also to deposit his travelling passport with the Registrar of the Court pending his formal arraignment.

In a ruling on the application for bail argued by Mathew Burkaa, SAN, Justice Adeniyi held that it is in the best interest of justice and fair play especially the provision of section 35 of Nigeria’s Constitution to follow the rule of law.

The Judge specifically said that there must be an end to detention without trial by the federal holiday.

Both the FG, and AGF re-presented by Oyin Koleoso had strongly objected to Emefiele’ s request for bail on the ground that he would interfere with the November 15 arraignment but did not tell the court how the interference would be done.

EFCC on its part through its counsel, Farouk Abudalla insisted that Emefiele had not spent three months in its own custody and urged the Court to refuse the bail request.

Counsel to the applicant however punctured the opposition of the Federal Government adding that the claim of likelihood of interference in arraignment was speculative because his client was not declared a flight risk.

He told Justice Ademiyi to disregard the claim of EFCC that Emefiele was brought to its custody only October 26.

The Senior lawyer informed the Court that the former CBN boss was investigated by a team of inter Ministerial Investigators from EFCC, Police and Department of the State Security Service DSSS which jointly constituted government agency.

  • Plateau South: PDP Loses Senatorial Seat To APC

Plateau South: PDP Loses Senatorial Seat To APC

The Appeal Court has nullified the participation of the People’s Democratic Party (PDP) and its Senatorial candidate in the February 25, National Assembly Election, Napoleon Binkap Bali, for Plateau South Senatorial District on ground of refusal to carry out lawful order of Court.

In a judgment delivered by Justice Elfaida Oluwayemisi Williams-Dawodu declared as unlawful and wasted votes cast for PDP in the election and declared the former Governor of the State, Simon Bako Lalong as the Senator for the Plateau South Senatorial District.

Lalong who stood for the election on the platform of the All Progressives Congress (APC) had come second in the February Senatorial election.

Justice Williams-Dawodu held that the PDP and its Senatorial candidate have no legal ground to participate in the election having failed to obey the judgment of a Plateau High Court that the party should conduct lawful elections for the purpose of having officers for Wards, Local Governments and State Council.

The Plateau High Court had in 2022 ordered PDP to conduct elections for selection of officers for Wards, Local Governments and the State Chapter of the party which was not complied with.

The Court of Appeal said that disobedience and disregard to clear lawful order of Court was fatal because PDP hurriedly put an illegal Caretaker Committee in place in utter confrontation to the Court judgment.

Specifically, the Appellate Court held that PDP did not sponsor any candidate for the Plateau South Senatorial District because it was not qualified to stand for any election as at February 25, 2023.

“As at February 25, PDP was on a faulty background at nomination of candidate for any election. It has no legal foundation upon which it’s candidate nomination can stand.

“A positive order of Court must be complied with unless such order is voided and set aside by a higher Court.

“In the instant case, the lawful existing and subsisting Court order was that PDP should conduct elections in line with provisions of the law to have officers at Wards, Local Governments and State Council but the party for reasons best known to it, opted to go against the order.

“I cannot but agreed totally with judgment of the Plateau National Assembly Election Tribunal which in its judgment of September 11, 2023 nullified the participation of PDP in the February 25 National Assembly Election”.

The Court of Appeal subsequently upheld the declaration of Simon Lalong as the lawful Senator for Plateau South Senatorial District having scored second highest votes at the election.

Other Justices of the Court of Appeal who agreed with the judgment are Mohammed Mustapha and Okon Abang.

Simon Lalong, the immediate past Governor of Plateau State is currently the Minister of Labour in the President Bola Tinubu’s administration.

Emefiele Must Be Released Or Produced By November 8, Court Orders EFCC

Justice Olukayode Adeniyi of an FCT High Court has again ordered the Economic and Financial Crime Commission (EFCC) to either produce or release the embattled former Governor of the Central Bank of Nigeria (CBN), Mr Godwin Emefiele, on November 8.

Justice Adeniyi gave the first order on Friday after hearing an ex parte motion, on fundamental right marked M/122/2023 in a Motion on Notice with the number, FCT/HC/CV/040/2023, filed by Emefiele.

Unfortunately, the EFCC could not obey the order at the resumed sitting on Monday as the EFCC counsel, Farouk Abdullahai, told the court that the order was not understood.

He added that the applicant could not attach some documents to his affidavit.

Emefiele ‘s counsel, Matthew Burkaa, SAN, had earlier told the court that his client had been in detention of the Federal Government for 149 days.

He however, promised that he would attach the omitted documents which among others were the charge.

Responding, Abdullahi, counsel for EFCC, said the applicant had only been in EFCC custody for seven days.

After listening to their submissions, Justice Adeniyi gave a reiterated order for the release of the applicant or produce him for bail on Wednesday.

He further directed the applicant ‘s counsel to attach the documents omitted in support of their affidavit and serve parties.

He then adjourned the matter until Wednesday.

Emeifele was first detained from June, when he was removed as CBN Governor, by the Department of State Service (DSS) and later transferred to EFCC last week, seeking his release.

Emefiele, through his legal team, joined the Federal Government, Attorney-General of the Federation (AGF), EFCC chairman and the anti-corruption commission as respondents.

Meanwhile, Emefiele was scheduled to be arraigned by the Federal Government before Justice Hamza Muazu of the FCT High Court, Maitama, on August 17 alongside two others, Sa’adatu Ramallan Yaro and a company, April1616 Investment Limited.

They were to be arraigned on a 20-count charge bordering on procurement fraud to the tine of N6.9billion, conferment of advantage and conspiracy.

The arraignment could, however, not hold due to the absence of Yaro, who was said to be sick and the matter was adjourned August 23.

Due to the plea bargain Emefiele was said to be discussing with the Federal Government, the matter is yet to be heard till date.

  • Recent Attack On Joe Ajaero Violates His Human Rights- NASU

Recent Attack On Joe Ajaero Violates His Human Rights- NASU

The Non-Academic Staff Union of Educational and Associated Institutions (NASU) has strongly condemned the recent attack on Mr. Joe Ajaero, the President of the Nigeria Labour Congress (NLC).

The union’s reaction to the incident was conveyed through a statement signed by its General Secretary, Mr. Peters Adeyemi, in Abuja on Sunday.

Ajaero fell victim to the attack in Imo State on November 1 when he traveled to the Southeastern state to declare a mass protest against alleged anti-labour practices.

The Witness had reported that Ajaero was subsequently detained by the police, although the police claimed that they took him into custody to protect him from further attacks by hoodlums.

Adeyemi firmly asserted that the attack on the union leader amounted to “a violation of trade union rights as well as the human rights of Ajaero.”

He emphasized that the rights exercised by Ajaero in Owerri, as the leader of Nigeria’s working people, are guaranteed by the Federal Republic of Nigeria’s 1999 Constitution (as amended) and International Labour Organization (ILO) Conventions.

“Nigeria, as an ILO member-state, has ratified ILO Conventions on Freedom of Association and Protection of the Right to Organize, 1948 (No.87), and the Right to Organize and Collective Bargaining, 1949 (No.98),” Adeyemi said, pointing out that the Imo government has been involved in unfair labour practices, as it has failed to pay salaries and pensions, making it unjustifiable to attack workers’ union leaders who inquire about the non-payment of these dues.

He noted that Ajaero was on a solidarity visit to the workers in Imo and should not have been subjected to treatment “common in Nigeria only during military regimes.”

NASU further rejected the claims that Ajaero was held under “protective custody” for his own benefit and called on President Bola Tinubu to initiate a thorough investigation into the incident.

The union concluded by saying that it firmly believes that such incidents should not deter the exercise of fundamental human rights, including those related to labour and trade union activities.

The Commanding Officer (FOB) Capt. Uche Aneke, disclosed this in Ibaka when he handed over the suspects and bags of rice to Nigerian Custom Service (NCS) in Ibaka at the weekend.

Aneke noted that the suspects were arrested around 6:20 p.m. on Thursday.

He said the Nigerian Navy (FOB), Ibaka received intelligence regarding suspected smuggling activities within the area of operation.

Aneke explained that the intelligence indicated that a boat was conveying some foreign parboiled rice suspected to have been smuggled from Cameroon to Nigeria and transiting within the waters under FOB, Ibaka Area of Operation.

“Yesterday, we were able to intercept a wooden boat carrying 18 bags of parboiled rice that are contraband items and they were concealed under 600 baskets of Tomatoes.

“Today, we are handing them to Nigeria Custom Service (NCS) for further investigation and persecution.
